Enterprise Chamber declares objections OR XS4ALL unfounded

Summary

The Enterprise Court of the Amsterdam Court of Appeal has ruled in favor of KPN and XS4ALL in two legal proceedings instituted by XS4ALL's Works Council (OR).

“It's good that everything is clear now,” says KPN CEO Joost Farwerck. “As far as I’m concerned, the most important thing is to consult with the employees of XS4ALL. At the beginning of the new year, I want to explore how we can work together to finalize matters successfully. For the time being, there will be no change to the service we offer our customers.”

In November, XS4ALL's Works Council instituted proceedings against XS4ALL under the Works Councils Act. The Works Council was of the opinion that the employee participation in the advisory process for the merger of XS4ALL and KPN had not been carried out properly. In addition, in November the Works Council also instituted an inquiry to show that there were reasons to doubt that a suitable policy had been followed. Both cases were filed with the Enterprise Court of the Amsterdam Court of Appeal at the end of November. The Enterprise Court dismissed the objections of the Works Council in both proceedings as unfounded.
